79-year-old Sunnyvale man arrested in Cupertino shooting

A 79-year-old Sunnyvale man was arrested in Cupertino over the weekend on suspicion of shooting an acquaintance, the Santa Clara County Sheriff’s Office said.

The shooting occurred Saturday evening in the 10700 block of Martinwood Way. Santa Clara County sheriff’s deputies responded around 7 p.m. to reports from neighbors of a gunshot followed by a man crying out that he’d been shot, the sheriff’s office said.

“There were, I think, at least three different people that called,” said Sgt. Rich Glennon, a spokesman for the sheriff’s office. “He was shot in the driveway and then some people heard the shot and some people heard him screaming for help.”

Upon arrival, deputies found a 48-year-old man who appeared to have been shot at least once in the driveway of his house. The victim was taken to a nearby hospital and treated for his injuries, which did not appear to be life threatening, the sheriff’s office said.

The suspect had left the area in a car, but deputies found him driving in Sunnyvale about four hours later and booked him into the county’s Main Jail on suspicion of attempted murder. He was identified as Richard Lane, 79 of Sunnyvale.

Investigators say the victim and Lane knew each other.

“They’re not related by blood, but (it’s) a close relationship,” Glennon said.

As of Monday evening, the sheriff’s office is still investigating if there was a dispute between the men.

“We believe to have it established, but investigators just want to make sure everything is tied up,” he said.

The sheriff’s office believes the shooting was not an accident.

“Based on witness statements and based on evidence at hand, this was an intentional act,” Glennon said. “Based on the parties and how they’re associated, it was not an accident.”
