Prosecutors charge woman who dropped child from second-story window

Santa Clara County prosecutors have filed charges against a 24-year-old woman who dropped her 22-month-old son from a second-story window in San Jose on Christmas morning.

Lupita Cortez, 24, will be arraigned in San Jose this afternoon on one count of endangering the health of a child and one count of inflicting corporal injury upon a child.

The boy suffered only minor injuries, according to police.

Officers were called to the 3500 block of Alden Way around 11:30 a.m. Sunday on a report that a mother had locked herself in a bathroom with her child, Sgt. Jason Dwyer said.

When police arrived and forced their way into the bathroom, she dropped the child out of a second-story window, he said.

Fortunately, the boy suffered only minor injuries described as “bumps and bruises,” Dwyer said.

Cortez jumped out the window after her child and also survived, suffering minor injuries to her feet.

She was taken to a hospital where she underwent a mental health evaluation.
