Man suspected in October homicide to enter plea in February

A San Jose man charged with the stabbing death of a 22-year-old man in October is expected to enter a plea next month.

Roberto Jaime Martinez, 29, of San Jose, was arrested on Nov. 29 on suspicion of killing Luis Diaz on Oct. 23, police announced Thursday.

Martinez remains in custody without bail at Santa Clara County Main Jail, according to Santa Clara County District Attorney’s Office spokeswoman Lisa McCrary.

Diaz was found unconscious on a sidewalk in the 200 block of West Virginia Street with at least one stab wound, police said.

He was transported to Santa Clara Valley Medical Center, where he later died.

Officers found Diaz around 1:40 a.m. after responding to a report of a fight in the nearby area of South Almaden Avenue and Union Street, which investigators believed was related to the stabbing.

On Feb. 15, Martinez is expected to plead to a homicide charge with enhancements.

On that date, he is expected to also plead to a probation violation on a separate domestic violence misdemeanor charge that occurred in February 2011 and two counts of assault with a deadly weapon and participating in a criminal street crime, which all occurred in November 2011.
